Negotiation Expert's Advice on Discounting ? Don't - Getting ...

(Part 1 of my conversation with Ron Hubsher, a pre-eminent expert in negotiation)

Whether looking to purchase capital equipment, a professional service, or other ?big-ticket item,? the corporate buyer is going to want to be sure that they are getting the best deal. Especially given the current economic environment, purchases will be evaluated and assessed much more closely as financial decisions are exposed to much greater scrutiny now than they might previously have received.? However; negotiation and sales expert, Ron Hubsher, of Sales Optimization Group (www.salesog.com), author of the book;??Closing Time: The 7 Immutable Laws of Sales Negotiation,? cautions against sellers trying to acquire business by using price discounting alone.

The Mindset

The sales person has? a tough sale to make before the first contact with a customer.? The first sale is to him or herself.? If the sales person does not believe that the offer (defined as more than the product or service?-rather the totality of what is being provided by the company in the transaction) is worthwhile or has value, then the default or fallback will often be to rely on price to complete the sale and create the transaction.? Once that ?sale? has been made, the next sale is to the prospect.

Hubsher recommends that sales people remember that resources are constantly being allocated and re-allocated on both the prospect and the seller?s side of the relationship.? The prospect?s organization may ?pull? budget to cover shortfalls in other areas within the company or re-prioritize objectives; the seller has to make determinations of where to expend resources across numerous opportunities; Hubsher identifies that, ?the great negotiators know that they have to provide rationale for why?the time is now to act.? The prospect has a problem that needs to be fixed immediately and the seller has the capacity and ability to commit to providing or contributing to the solution currently.?? The recognition that the two parties need each other to succeed and that there is an urgency to resolving the problem is at the core of Hubsher?s approach.

Hubsher dissuades sellers from relying on discounts to close sales and refers to it as ?BS.?? However, what he means by that is Belief System.? He shares a story of how a client of his promoted an SE (Service Engineer ? a technically proficient person who often helps with scoping out the technical needs of a computer installation or assists in implementation) to sales person, but Sales Management had told him that he is not permitted to offer discounts as part of his selling activities.? Given that he believed that discounts were not permitted, he then went out and outsold all of his peers and was surprised when he received a sales award for his performance to hear that all of his peers had actually been using discounts (and were less successful than he was).

Importantly, Hubsher points out that discounts do not create value.? Value is not about hitting a price point as much as it is about providing a reduction in risk.? The buyer is evaluating the risk of going with one vendor or solution over others by looking at:

  1. Professional or business risk ? will the solution accomplish the business purpose it is designed to meet?
  2. Personal risk ? will there be personal jeopardy or opportunity afforded to the individual if one vendor/solution is chosen over others?

    Discounting can have a deleterious impact over time.

Reduce Risk

As opposed to offering a lower price, Hubsher counsels that providing greater value that equals or even exceeds the discount requested is the?preferred approach.? So, training, implementation support, providing references of previous installations, etc. should be offered to reduce the perceived risk and enhance the value of the purchase (often at a relatively low expense to the selling organization).? Increasing the ?premium? nature of the offer, rather than racing to the bottom by stripping cost out of the purchase serves both parties more positively.

Another issue that companies may confront once they begin to offer discounts is that they inadvertently create liabilities for themselves by discounting across current and future sales opportunities.? Hubsher explains:

  • Companies that have multiple ?buying points? (regions, offices, departments, etc.) can compare ?deals? offered and then demand the most lucrative deal provided and expect it to be provided across all company purchases regardless of location
  • Companies may purchase other companies and eventually uncover the difference in discounting offered to each and then expect the lower price to apply across the newly formed company
  • Individuals may change organizations and upon learning that a prior company was offered a better deal than the current one, may demand the same parameters as had been established in the original company.

Venezuelan diplomat held over ambassador's killing

NAIROBI, Kenya - Kenyan police have arrested a Venezuelan diplomat over the killing of the country's acting ambassador in her official residence, the High Court heard Monday.

Venezuela's acting ambassador and charge d'affaires, Olga Fonseca, was found dead in her official residence on Friday. Police said she was strangled, though the motive is unclear.


Dwight Sagaray, first secretary at the Venezuelan Embassy, was arrested on Saturday and Kenyan police on Monday made a court application to hold him in custody for another 14 days.

"The suspect was arrested by the police after his diplomatic immunity was waived," deputy prosecutor Tabitha Ouya told the courtroom.

'Investigation is incomplete'
Sagaray, wearing a yellow and green baseball jacket, appeared composed as Venezuelan?officials observed the proceedings.

"The investigation is incomplete and (we) require more time to secure crucial evidence and apprehend other suspects," Ouya said.

According to Kenya Capital FM News,?Ouya said authorities needed to interrogate more witnesses and also awaited the results of DNA samples taken at the scene of the crime.

Sagaray was arrested along with five Kenyans who worked at the Embassy but it was unclear whether the local suspects have been charged or released.

Kenyan Foreign Ministry officials said local staff at the residence had complained to its Diplomatic Police Unit after the new envoy fired them.

Fonseca had sacked them after they refused to retract sexual harassment claims against the former head of the Venezuelan Embassy, the employees said.

Fonseca, 57, had only been the country since July 15, the EFE news agency reported.

Jose Miguel Reyes, administrative assistant at the Venezuelan Embassy, told EFE?that the servants "were never fired," but they had "refused to acknowledge Fonseca's authority" and kept working at the residence anyway.

Judge Florence Muchemi will rule Tuesday whether to remand Sagaray in custody or release him on bail.

Post-mortem results and DNA analysis have not yet reached police investigators, according to court documents.

Patent suit may decide smartphone's future

(Updated 3:23 p.m. Eastern) While patent law doesn?t have a reputation for being scintillating stuff, the lawsuit between Apple and Samsung is the exception. How the case is decided could have a potentially serious impact on nearly every American who uses a smartphone.

Apple contends that the Korean manufacturer ripped off the iPhone?s look and feel. "It's the cool factor, and they feel like Samsung took that," said?Joseph A. Mandour, managing partner of Mandour & Associates. The company is?seeking $2.5 billion in damages and permanent injunctions against sales. Legal experts say the case and its inevitable appeals will probably drag on for years. Neither side seems inclined to settle because there isn't a clear-cut prediction for the outcome, especially because the case is being tried before a jury.

A partial or complete victory by Apple could, in the most extreme case, lead to a ban on sales. "(If)?there?s some sort of an injunction, that becomes a loss for the consumer market in general," said?Will Stofega, mobile devices analyst at International Data Corporation.

Analysts say it's more likely that an Apple victory would force changes to the way Samsung?s phones and tablets look and function. "Samsung's probably got a work-around," said?Kevin G. Rivette, patent expert and managing partner at 3LP.?In Germany, for instance, Samsung added a slim frame around the front of a contested Galaxy tablet to get around Apple?s contention that a wholly glass front was its invention.?Small tweaks might be enough to bring Samsung within the letter of the law here, too.

On the other hand, "If Apple wins on some of the really fundamental technologies... consumers will notice," said Polk Wagner, professor at University of Pennsylvania Law School. "Dragging, scrolling -- what we now think of as completely normal --?these are some of the fairly fundamental ideas of how someone interacts with these new devices."

"At the heart of this lawsuit is this same issue, which is: How do I differentiate my product from the other guy?s in a market that seems to be rapidly moving?" said Stephen Baker,?consumer technology analyst at NPD Group. "Each company wants you to be comfortable within their ecosystem."?

Samsung already scrapped a local search feature in some Galaxy phones and tablets in response to patent issues. Patent experts say it?s possible that a decision could force?Samsung to take away other features or make them radically different, which is a disconcerting prospect for users who have grown used to that interface's look and feel.

Mandour?said Apple has stronger grounds to argue that it has been damaged because of lookalike design elements on Samsung devices rather than the alleged co-opting of functions; consumers are more likely to make a purchase decision based on how the phone looks than whether scrolling past a screen will create a ?bounce? effect.

If Samsung is entitled to damages from Apple, Rivette said the price of iPhones could be impacted??marginally,? ?although the company might decide against passing along that cost to consumers, given the profits it earns on the iPhone. "You?re looking at margins that are so huge that if you want to keep market share, you just eat it," he said.

Over the course of litigation, Apple might seek a temporary injunction to block sales of some Samsung devices, a tactic in which it has had some success in the past.?This would frustrate consumers who wanted to buy the phone or tablet, but it could turn out to be a boon for Apple; the tech giant is coming off a rare lackluster quarter, and it predicted that this quarter also will be only fair as customers hold back and wait for the new iPhone.

"I think what you're really looking at here is if Apple can get an injunction, even temporarily for a couple months, then you?re into the Christmas quarter," Mandour said. "Apple needs a good quarter," and having its main competitor knocked out of the running could certainly help achieve that.?

In Israel, Romney talks Iran, angers Palestinians

White House hopeful Mitt Romney Sunday held top-level talks in Israel over Iran's nuclear ambitions but quickly drew fire from the Palestinians for endorsing Jerusalem as the capital of the Jewish state.

"We must lead the effort to prevent Iran from building and possessing nuclear weapons capability," the Republican challenger said in a speech given on a rooftop overlooking Jerusalem's Old City in which he laid out key foreign policy issues facing Israel.

"We should employ any and all measures to dissuade the Iranian regime from its nuclear course," he said, expressing hope that diplomatic and economic measures would help achieve this aim, but adding that "in final analysis, of course, no option should be excluded."

"We recognise Israel's right to defend itself, and that it is right for America to stand with you," said Romney, the Republican challenger who will face off against President Barack Obama in November's US election.

Israel, which is widely believed to have the Middle East's only, albeit undeclared, nuclear arsenal, has warned that a military option cannot be ruled out to prevent Iran from developing atomic weapons capability. Tehran insists its nuclear programme is for peaceful purposes only.

According to Israeli public radio, Prime Minister Benjamin Netanyahu told Romney it was important to have "a strong and credible military threat" because sanctions and diplomacy "so far have not set back the Iranian programme by one iota."

The White House hopeful, who arrived in Israel from Britain late Saturday on a one-day visit, stepped into the quagmire of Middle Eastern politics when during his policy speech he hailed Jerusalem as Israel's capital.

"It is a deeply moving experience to be in Jerusalem, the capital of Israel," he said, in an apparent endorsement of a position held by the Jewish state but never accepted by the international community.

Netanyahu thanked him for his remarks, later telling him: "I want to thank you for those very strong words of support and friendship for Israel and for Jerusalem that we heard today."

But the Palestinians were infuriated, saying his remarks were "harmful to American interests in our region."

"They they harm peace, security and stability," Palestinian negotiator Saeb Erakat told AFP.

"Even if this statement is within the US election campaign, it is unacceptable and we completely reject it. The US election campaign should never be at the expense of the Palestinians," he said.

"Romney is rewarding occupation, settlement and extremism in the region with such declarations."

Israel, which occupied the largely Arab eastern sector during the 1967 Six-Day War and later annexed it, claims both halves of the city to be its "eternal and undivided capital."

But the Palestinians want the eastern sector as capital of their promised state and fiercely oppose any Israeli attempt to extend sovereignty there.

Most of the international community, including the United States, does not formally recognise Jerusalem as Israel's capital due to the ongoing conflict, insisting the issue can only be resolved through final status negotiations.

Romney has consistently attacked what he says is Obama's weak and misguided Middle East policy, saying in January that the president "threw Israel under the bus," by defining the 1967 borders as a starting point for Israeli-Palestinian negotiations.

On Egypt, Romney said he would work to ensure Cairo's new Islamist President Mohamed Morsi would protect the 1979 peace treaty with Israel.

"With the Islamist president elected in Egypt we hope to use the considerable weight of the world's influence to ensure a continued commitment to the agreements of peace... with Israel."

In a show of support for Israel ahead of Romney's tour, Obama on Friday signed a law reinforcing US security and military cooperation with Israel as representatives of the pro-Israel lobby AIPAC stood beside him in the Oval Office.

First look?Trailer for the new documentary on poster artist Drew ...

I love good documentaries, and ever since I heard a high quality documentary about the work of Drew Struzan was in production I have been waiting to learn more.? If you don?t know about Drew Struzan, check out this review of a book?about him from an earlier article here at borg.com.? So far, there is no apparent release date yet established.? But the filmmakers have just released this trailer:

We reviewed Being Elmo documentary?here several weeks ago, a great insight into the creator that worked and voiced the muppet Elmo for Sesame Street.??Kevin Clash?s?story really came through and made this an award-winning documentary.? As non-fiction genre-related documentary films go, there is not a lot out there that is of the quality that you?d recommend it to others, especially those that aren?t fans of documentaries.? The History Channel?s History?s Mysteries documentary of a lost aircraft called the Lady Be Good was just as intriguing as any murder mystery and should serve as a guide for compelling storytelling in non-fiction filmmaking.? The public television documentary called The Proof, documenting the discovery of the solution to Fermat?s Theorem by Andrew Wiles was enormously compelling, despite its seemingly bland subject matter.? Wouldn?t it be great if we had a documentary about genre-related interests that were as well made as these films?

I can?t make myself watch Comic-Con Episode IV:? A Fan?s Hope or Trekkies.? I?ve seen enough excerpts that make it clear that, despite the filmmaker?s claims, these were made by outsiders looking in more than insiders themselves who live and breathe, and more importantly, understand,?their passion.? Who wants to watch an outsider highlighting the fringe of the fan bases?? I also was disappointed in Rod Roddenberry?s recently released?Trek Nation documentary.? First, there is nothing Trek Nation about Trek Nation.? It should be called Son of Trek because the film is entirely about Rod and his attempt to understand?his late father Gene.? It?s not a fun show to watch, and actually ends up rather depressing and sad.? No one wants to view someone else?s daddy issues, no matter who the daddy or the son is.? Folks who?know Rod Roddenberry have good things to say about him, which makes it more unfortunate that his film makes him look a bit like an angry trust fund kid.??And choice of material wasn?t thought out well.? The?documentary?includes an?interview with George Lucas that is painful to watch, and it comes off like it is an attempt at starting a Star Wars vs. Star Trek battle with Lucas himself.? So there are good and bad documentaries, and finding and creating gems takes some work.

So looking at the trailer for Drew: The Man Behind the Poster, you can tell the filmmakers realized the importance of their subject, and they went to appropriate sources for their interviews.? I have always wanted to?hear what Harrison Ford thought of all the Star Wars and Indiana Jones and Blade Runner marketing that included his image.? I love that we will get to hear Michael J. Fox talk about Struzan?s impact on his movies.? Who wouldn?t want to get a look at the creative process behind such a legendary modern artist?? And just look at the filmmakers who are interviewed for this film, including Steven Spielberg, George Lucas, and Guillermo Del Toro.

The only missing piece?is a release date, but as soon as it is released?I will update this with that information.? It?s definitely a film we should all look forward to, and hopefully it will live up to this well-made preview.

Almost 27 million Britons watched opening ceremony

LONDON (Reuters) - Almost 27 million Britons watched the Olympic opening ceremony, trumping viewing figures for last year's royal wedding and underscoring a growing sense of excitement as London hosts the Games for the third time.

Around the globe, approximately one billion people were reported to have watched director Danny Boyle's celebration of British history and culture on Friday, the UK government said on Saturday.

The domestic audience peaked at 26.9 million during a section featuring dancing doctors and nurses in a tribute to Britain's state-funded National Health Service, according to figures from the BBC.

Britons showed plenty of stamina during the near four-hour show. More than 19 million were still watching when the Olympic cauldron was lit at half past midnight.

Britain has spent around nine billion pounds to build and stage the Games, returning to London for the first time since 1948.

Some Britons questioned the cost at a time of deep cuts in government spending while fears over security and transport furthered tempered enthusiasm for the world's biggest sporting event.

However, the mood appears to have lifted as the Games finally got under way after seven years of preparation.

The television audience for last year's wedding of Prince William and Kate Middleton peaked at 26.3 million when the couple reached the altar in Westminster Abbey, according to industry data.

The royal wedding was shown on several British channels, while the BBC has the exclusive rights to the Olympics.

England's 1966 World Cup victory over West Germany is the most watched programme in British television history, with an estimated audience of 32.3 million, according to research by the British Film Institute.

The 1997 funeral of Princess Diana also drew an audience of more than 32 million.

Google has a knack for coming up with features that you never even realized you need until they exist.

Google Handwrite is one of those features.

As Google software engineer Rui Ueyama explains on the official Google blog,?Handwrite is simply?another way to conduct Web searches from your smartphone or tablet.?It means that you can now?write out search terms with your finger instead of tapping them out the good old-fashioned way. (You can still also search using your voice or an image, of course.)

It sounds like a silly feature at first, but?you'll likely fall in love with it after a couple of tries. I most certainly did.

As someone with handwriting so atrocious that I should be a medical professional, I expected that Handwrite would fail to recognize any query I tried. But instead, it flawlessly transcribed three out of every five words, no matter how long or bizarre they were. I tried to trip the feature up by mixing?cursive and block letters, but no dice?? Handwrite still did pretty well. It even worked like a charm when I wrote with my eyes closed and one of my hands?metaphorically?tied behind my back.

I have a hunch that once one gets used to writing things out on a mobile device's screen, it could become a faster to search than good ol' typing.

To try Handwrite yourself, you'll need?an Apple device running iOS 5 or higher, an Android smartphone running Android 2.3 or higher, or an Android tablet running Android 4.0 or higher. Audyssey's Audio Dock is pretty versatile. It's a Bluetooth speaker system with a docking area for iPhones and iPods, which means just about any modern mobile device can wirelessly stream to it, and several Apple gadgets can play through it directly. At high volumes, the Audio Dock manipulates the frequency response with some signal processing to avoid distortion issues, which will irk many purists, but generally, audio performance is solid. At $399.95 (direct), the speaker system is a bit more affordable than most docks this size that offer wireless playback. The ability to take calls through the speaker system itself is another thoughtful extra, making the Audio Dock , despite some flaws, a wireless option worth considering.

Design
The 9-by-5-by-11-inch (HWD) Audio Dock's overall design is simple and sleek. It's all black plastic and black metallic speaker grille, with a narrow front panel and two deep side panels that house the speakers. Under each grille is a 0.75-inch tweeter and a 4-inch woofer, and all four drivers are individually amplified. An under-lit button on the top panel controls playback?we found it sometimes required repeated taps to do the trick.

On the front panel, a narrow, under-lit vertical sliver displays the Volume level. But the actual Volume controls are cleverly hidden behind the Audyssey logo on the iPhone docking area, near the bottom of the front panel. Pressing the left side of the logo lowers volume, while the right side raises it; press and hold the middle of the logo briefly, and it mutes the audio. A rubber bumper to support the backs of docked iPhones or iPods is also situated on the front panel.

Beneath the volume indicator, there's a microphone for taking calls through the speaker system?you answer using the remote control. The back panel houses another microphone (they work together for better voice processing and clarity), as well as a Bluetooth pairing button, the Power switch, a 3.5mm microphone output (for sending your voice through your computer for VoIP calls), a 3.5mm aux input, and a mini USB port. A USB cable is included, allowing you to sync docked iPhones and iPods with connected computers, and there's an "autosync disable" button on the back panel?when pressed, it defeats the connected USB and stops a docked iPhone from syncing to iTunes. The Audio dock ships with the aforementioned USB cable, two 3.5mm cables for connecting to the rear ports, and a power cable. Also included is a frustrating remote control. It's actually got a bunch of useful features?standard Volume controls, Play/Pause, Track Skip Forward/Backward, as well as Mic Mute and Audio Mute buttons. The best feature is the Phone button, which allows you to answer calls via the speakers, but the frustration comes from the remote's need for a very precise angle to actually work. If you don't aim at just the right spot on the dock, it simply doesn't register at all. Once you get past that, however, the remote is above average, and the system's inclusion of all the necessary cables is also a nice plus.

The system supports Bluetooth (A2DP) streaming, and a free app is available for adjusting the EQ if you wish, though we recommend skipping this pretty unnecessary feature?the system sounds better without any EQ adjustments.

Performance
The Audyssey Audio Dock offers a powerful audio experience, but as mentioned earlier, it's not for purists or audiophiles. The reason for this is twofold: It employs digital signal processing at top volumes to prevent distortion from deep bass, and its speakers are angled in opposing directions, which certainly fills a room, but also obliterates the stereo balance and the concept of a "sweet spot" for listening.

This isn't entirely without merit: The alternatives to digital signal processing are either to let the speakers distort, which sounds just as bad or worse than the gradual volume lowering of deep frequencies when the system is at top volume, or to build more powerful speakers, which would probably cost substantially more. The Audio Dock isn't alone in its use of DSP?the Bowers & Wilkins MM-1 ?(4 stars) and the Audyssey Audio Dock Air ?(3.5 stars), an Apple AirPlay dock from Audyssey, both employ similar processing.

As a result of the DSP, tracks with deep bass, like the Knife's "Silent Shout," don't really distort at top volumes (when both the volume on your streaming phone and the dock itself are maxed out), or if they do, it's only momentarily until the processing fixes things. But as the volume rises, the deep bass presence gets dialed back and the overall response sounds noticeably thinner. Big electronic bass drum hits are reduced more or less to their treble-heavy attack, minus the sub-bass resonance behind them, and stringed instruments lose much of their low-end resonance.

In other words, this system can get loud, but it's probably not the best choice for your party if you want to blast loud electronic music or hip hop?it shouldn't really distort all that much, if at all, but it will not sound terribly balanced and full, either. At slightly less intense volumes, however, the Audio Dock offers plenty of low frequency response?and can still do so at fairly loud volumes, just not as much so at top volumes.

At moderate volumes, everything sounds better?not just "The Knife," but also instrumental music like John Adams' modern classic piece, "The Chairman Dances." On this recording, the Audio Dock showcases a pleasant overall balance, with the lower register strings and percussion neither disappearing into the mix (which is entirely possible with more subtle pieces like this) nor overstepping their place in it. The mids and highs are clear and precise, allowing wood percussion and higher register stringed instruments to shine without ever sounding harsh or overly crisp.

As mentioned earlier though, this is not a system for critical listening?few phone dock systems are, to be fair. It still can sound great, and the Audio Dock fills a room admirably for a system this size. But with the angling of the high frequency drivers upwards and away from each other, as well as the low frequency drivers at near exact opposite angles from each other and differing angles from their corresponding high frequency drivers, there is no hope of finding a "sweet spot" to listen from.

On the plus side, the difference between audio performance when an iPhone is docked and when the same iPhone is streaming the same song via Bluetooth is negligible. The pairing process is simple and quick, but we did have occasional issues with playback?it seemed as if the docked iPhone was being controlled by another nearby remote control, as it would occasionally pause playback without any prompting. The stream was not disrupted, the iPhone simply paused the audio. It's entirely possible that the PCMag Labs was the culprit?there can be a lot going on in here and even on the floor below us, but if you if you live in a large apartment building or in a home with several remotes being used, the same may be true for you.

Overall, the Audio Dock offers a high quality stream, as long as you keep the volume at reasonable levels. If you'd rather have a more traditional stereo image, but still want a wireless Bluetooth system, our current Editors' Choice is the excellent JBL OnBeat Xtreme ?(4.5 stars). Its offbeat design likely alters the stereo image slightly, too, but everything's generally pointed in the right direction and the speakers are quite powerful. There are some AirPlay docks that are also excellent choices, if you'd rather use Apple's Wi-Fi based streaming audio feature rather than Bluetooth, though they are all more expensive, such as the Klipsch Gallery G-17 Air ?(4 stars). Audyssey's Audio Dock, however, is slightly less expensive than much of the serious wireless dock competition, and at moderate volumes you get quality output, and some nice extra features.?
